Terms of Service

1. Agreement to Terms

By accessing or using The Attraction Builder ("the Platform"), operated by Jen Cote ("we," "us," or "our"), located in New Liskeard, Ontario, Canada, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

The Attraction Builder is an online training platform that teaches attraction marketing principles. The Platform includes interactive training modules, AI-powered marketing material generation, worksheets, and related tools. As you complete training modules, the Platform generates personalized marketing materials based on your responses.

3. Account Registration

To access the Platform, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

New users receive a 7-day free trial with limited access to the Platform at no cost and with no credit card required. The free trial includes access to Modules 1-3, 50 AI draft credits, Story Builder (Phase 1), and 3 Conversation Helper threads. After the trial period, continued access requires a paid subscription.

Full access to the Platform requires a paid monthly subscription starting at $97 USD per month. Payment is processed through Stripe or PayPal, third-party payment processors. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel your subscription.

Subscription fees are billed at the beginning of each billing cycle. You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will retain access until the end of your current billing period.

5. AI-Generated Content

The Platform uses artificial intelligence to generate marketing materials based on your inputs. Text content (copy, posts, plans, story drafts, conversation replies, etc.) is generated by Anthropic Claude from your worksheet responses. Images (Image Studio) are generated by fal.ai's hosted models (Ideogram, Google Gemini 2.5 Flash Image, and Flux) from the prompts you write and any reference images you upload or pick from your Brand File.

All AI-generated content is provided "as-is" and may require your review and editing before use. You are solely responsible for reviewing, editing, and approving any AI-generated content (text or image) before publishing, distributing, or using it commercially.

Ownership. You retain ownership of your worksheet responses, prompts, reference images you upload, and any marketing materials (text and images) generated from them. We do not claim ownership of your content. The underlying AI providers (Anthropic, fal.ai, Ideogram, Google, Black Forest Labs) also do not claim ownership of the outputs you receive through the Platform.

Your responsibilities when generating images. You are responsible for ensuring that anything you generate and use is consistent with applicable laws and the rights of third parties. In particular:

• You may not generate images that infringe a third party's trademark, copyright, or right of publicity — for example, generating brand logos you don't own, copying other creators' work, or producing recognizable images of real people without their permission.
• You may not generate sexually explicit content, content depicting minors in any sexualized context, deepfakes intended to deceive, or content that promotes hate, harassment, or violence.
• When you upload reference images (to your Brand File library or as one-off references), you confirm that you have the right to use those images and to share them with our AI image providers for processing.
• When you use generated images commercially, you are responsible for any required model releases, trademark permissions, or rights clearances.

We may suspend access to AI features or terminate accounts for misuse, including repeated attempts to generate prohibited content or content that infringes third-party rights.

6. Acceptable Use

You agree not to:

• Share your account credentials with others
• Redistribute, resell, or republish course content
• Use the Platform for any unlawful purpose
• Attempt to reverse engineer or copy the Platform's technology
• Use automated tools to scrape or extract content from the Platform
• Harass, abuse, or harm other users

7. Intellectual Property

All training content, course materials, templates, brand assets, and Platform design are the property of Jen Cote and are protected by copyright and intellectual property laws. Your subscription grants you a personal, non-transferable license to access and use the materials for your own business purposes only.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or that any specific results will be achieved from using the training materials.

Income and results from applying attraction marketing principles vary based on individual effort, market conditions, and many other factors. We make no guarantees regarding income or business results.

9. Limitation of Liability

To the maximum extent permitted by law, Jen Cote and The Attraction Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify subscribers of material changes via email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.
